Complete this form by 12:00pm Friday, May 12, 2023, to have the self-guided tour brochure mailed to your home prior to the event. All garden tour registrants will receive an electronic copy of the brochure via email a few days before the Garden Tour and Open House. There will also be printed copies available at each Garden Site and Open House. 

NatureScape Garden Tour Terms and Image Release Waiver

[To be signed by each Participant 18 years of age or older.  Minor children must be under the supervision of an adult.]

I, the undersigned, enter in to this RELEASE OF LIABILITY, VOLUNTARY ASSUMPTION OF RISK with the Moulton Niguel Water District (“MNWD”) in connection with participation in the 2023 NatureScape Garden Tour (“Tour”). 

1.   I acknowledge that the Tour includes viewing private properties and as a result, I will not disclose, use, photograph or record the addresses of the properties or identifying information of the residents. 

2.  I acknowledge that the Tour involves viewing front yard landscapes only.  The Tour does not include access to private property.  The Tour is limited to observing landscapes from safe locations within public rights-of-way, sidewalks and other areas open to the public.  I am voluntarily participating in the Tour and I acknowledge that my attendance involves known and unknown risks of injury (for example only: tripping, falling) and damage to or loss of property.

3.   I hereby indemnify, defend, and hold MNWD harmless and not liable and release MNWD from all liability whatsoever and agree not to sue MNWD on account of or in connection with any claims, injuries, losses, damages, costs or expenses related to the Tour.    

4.  I do hereby consent and grant permission to MNWD to copyright, use and publish photographs and/or media recordings taken of myself and/or my minor child(ren) during the Tour for use in any and all media in perpetuity.  I hereby waive any right to the finished photographs, media recordings, and printed or electronic matter that may be used in conjunction with this event now or in the future, whether that use is known to me or unknown, and I waive any right to royalties or other compensation arising from or related to the use of photographs and/or media recordings.  I further  waive and release MNWD from any and all claims arising out of or in connection with the use of said photographs or recordings, including but not limited to claims for invasion of privacy, appropriation of likeness, or unauthorized commercial use.

I HAVE CAREFULLY READ AND FULLY UNDERSTAND THE FOREGOING RELEASE.
